Privacy Policy

Effective date: July 25, 2026 | Last updated: July 25, 2026

Winyah Bay Pools (“Winyah Bay Pools,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through winyahbaypools.com (the “Site”) and through our sales and service process, how we use it, who we share it with, and the choices you have.

By using the Site or submitting information to us, you agree to the practices described in this Policy. If you do not agree, please do not use the Site.

2. Information We Collect

Information you give us directly

When you complete our “Free Quote” form, call us, text us, or email us, we may collect:

  • Your name
  • Phone number
  • Email address
  • Your town, service address, or property location
  • Details about your project (pool model interest, budget range, timeline, yard conditions, photos you choose to send)
  • Any other information you voluntarily include in a message to us

Information collected automatically

When you visit the Site, certain information is collected automatically by us and by our analytics and advertising partners, including:

  • IP address and general geographic location derived from it
  • Browser type, device type, operating system, and screen size
  • Pages viewed, time on page, scroll depth, links clicked, and forms started or submitted
  • The website, ad, or search that referred you to us
  • Cookie identifiers, device identifiers, and similar advertising identifiers

Information from third-party identity resolution

Please read this section carefully. Our Site uses an identity resolution pixel (also called a visitor identification or website de-anonymization technology). This technology works with third-party data providers to attempt to match the anonymous device and cookie identifiers of Site visitors against those providers’ existing databases.

When a match occurs, we may receive contact and demographic information about you — such as your name, postal address, email address, or phone number — even if you did not fill out a form on our Site. This information comes from the data provider, not from you.

We use this information only to follow up about pool installation services and related offers. If you do not want us to collect or use this information about you, see Section 7: Your Choices and Rights, or simply contact us and ask to be removed. We will honor your request.

Information from other sources

We may also receive information about you from advertising platforms, lead-generation partners, referral sources, financing partners you apply through, and publicly available records such as county property data.

3. How We Use Your Information

We use the information we collect to:

  • Respond to your quote request and answer your questions
  • Prepare estimates, proposals, contracts, and project schedules
  • Contact you by phone, text message, or email about your project
  • Coordinate permitting, excavation, plumbing, electrical, decking, and other work with our subcontractors and suppliers
  • Send you follow-up messages, promotions, seasonal offers, and service reminders
  • Measure and improve the performance of our website, ads, and marketing
  • Build audiences for advertising and retarget visitors who did not complete a quote request
  • Detect and prevent fraud, spam, and abuse
  • Comply with our legal, tax, licensing, insurance, and warranty obligations

4. Text Messaging (SMS/MMS) Terms and Consent

By providing your phone number to Winyah Bay Pools — through our quote form, by calling us, or by texting us — you agree that Winyah Bay Pools and its authorized representatives may contact you at that number by phone call and by SMS/MMS text message, including messages sent using automated technology, regarding your inquiry, your project, appointment scheduling, and promotional offers.

Consent is not a condition of purchase. You do not have to agree to receive marketing text messages in order to buy a pool or receive services from us. You may call us instead at (843) 713-8440.

We do not sell, rent, or share mobile phone numbers or SMS consent with third parties or affiliates for their own marketing purposes. Mobile information collected for text messaging is used only by Winyah Bay Pools and the service providers that help us deliver those messages, and it is never shared for third-party marketing.

Message frequency

Message frequency varies based on your inquiry and project status. You may receive messages when you request a quote, while your project is being scheduled or built, and occasionally about promotions or seasonal service reminders.

Message and data rates

Message and data rates may apply. Standard rates from your mobile carrier apply to any messages you send or receive.

How to opt out

You may opt out of text messages at any time by replying STOP to any message from us. You will receive one final message confirming that you have been unsubscribed, and we will send no further texts to that number unless you opt back in. You may also opt out by calling or emailing us using the contact information in Section 1.

How to get help

Reply HELP to any message for assistance, or contact us at (843) 713-8440 or winyahbaypools@gmail.com.

Carrier disclaimer

Mobile carriers are not liable for delayed or undelivered messages.

5. Cookies, Analytics, and Advertising Technologies

We and our partners use cookies, pixels, tags, local storage, and similar technologies on the Site. These technologies fall into the following categories:

  • Strictly necessary — required for the Site to load, display correctly, and for forms to submit securely.
  • Analytics — we use Google Analytics to understand how visitors find and use the Site so we can improve it.
  • Advertising and conversion tracking — we use Google Ads and the Meta (Facebook and Instagram) Pixel to measure which ads generate quote requests and to show ads to people who have visited the Site or who resemble our past customers. These platforms may set cookies and combine Site activity with data they already hold about you.
  • Identity resolution — as described in Section 2, we use an identity resolution pixel that may match your device to contact information held by third-party data providers.

To learn how these companies use data, see:

You can also control cookies through your browser settings and limit interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org. Blocking cookies may cause parts of the Site to work incorrectly.

Do Not Track

Web browsers may transmit “Do Not Track” signals. Because no common industry standard for these signals has been adopted, the Site does not currently respond to them.

6. How We Share Information

We do not sell your personal information for money. However, our use of advertising and identity resolution technologies may be considered a “sale” or “sharing” of personal information for targeted advertising under some state privacy laws. You may opt out as described in Section 7.

We share information in these situations:

  • Service providers — website hosting, form and CRM software, email and text messaging platforms, phone systems, and scheduling tools that operate on our behalf.
  • Subcontractors and suppliers — excavation, plumbing, electrical, concrete, decking, and equipment vendors who need your name, address, and project details to perform work.
  • Advertising and analytics partners — Google, Meta, and our identity resolution provider, as described in Section 5.
  • Financing partners — only if you choose to apply for financing, in which case that lender’s own privacy policy governs the information you submit to them.
  • Professional advisors — attorneys, accountants, and insurers, as needed.
  • Legal and safety — when required by law, subpoena, or court order, or to protect our rights, property, or the safety of any person.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of all or part of our business.

As stated in Section 4, mobile phone numbers and SMS consent are excluded from any sharing for third-party marketing purposes.

7. Your Choices and Rights

Regardless of where you live, you may contact us at any time to:

  • Request a copy of the personal information we hold about you
  • Correct information that is inaccurate
  • Request deletion of your information
  • Opt out of marketing emails (click “unsubscribe” in any email)
  • Opt out of text messages (reply STOP)
  • Ask us to stop calling you
  • Opt out of targeted advertising and identity-resolution matching

To make a request, email winyahbaypools@gmail.com or call (843) 713-8440. We will respond within a reasonable time and will not discriminate against you for exercising these rights. We may need to verify your identity before acting on a request.

State privacy rights

South Carolina does not currently have a comprehensive consumer data privacy statute. However, residents of states such as California, Virginia, Colorado, Connecticut, Texas, and others have specific statutory rights, which may include the right to know, access, correct, delete, obtain a portable copy of, and opt out of the sale or sharing of personal information and targeted advertising, and the right to appeal a denied request. We honor these requests from any visitor, regardless of state of residence. If we deny your request, you may appeal by replying to our response, and you may contact your state attorney general.

8. Data Retention

We keep quote requests and customer records for as long as needed to serve you and then as long as necessary for warranty, tax, licensing, insurance, and legal purposes — typically several years after a project is completed, and longer where a warranty or law requires it. Marketing contact records are kept until you unsubscribe or ask us to delete them.

9. Security

We use reasonable administrative, technical, and physical safeguards to protect the information we hold, including secure hosting and access controls. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please do not send sensitive information such as Social Security numbers or full financial account numbers by email or text.

10. Children’s Privacy

The Site is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it.

11. Third-Party Links

The Site may link to third-party websites, including pool manufacturers and financing companies. We are not responsible for their content or privacy practices. Review their policies before providing information.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be noted on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.
